2. General Privacy Policy for Collaborators

The confidentiality and due protection of the personal information entrusted to PROBIOMED is of the utmost importance for us. PROBIOMED is committed to manage your personal data in a responsible way and in compliance with the provisions of the Federal Law for the Protection of Personal Data Held by Private Parties (hereinafter the “Law”) and other applicable regulations.

PROBIOMED requires to collect certain personal data to carry out the intrinsic activities to its commercial activity and line of business. PROBIOMED has a legal and social obligation to comply with sufficient legal and security measures to protect the personal data it has collected for the purposes described in this privacy policy.

All the above is done with the aim of assuring you full control and decision over your personal data. Therefore, we recommend that you read the following information carefully.

2.1. Data responsible.

PROBIOMED S.A. de C.V. is a company incorporated in compliance with Mexican laws, located at 499 Ejército Nacional Ave, Granada, Miguel Hidalgo, 02020, CDMX, Mexico.

2.2. Collected personal and sensitive data.

As part of our employee records, certain information susceptible to personal identification about you may be collected and processed. Among the aforesaid information, it may be included, but not limited to, the following:

1) Identification data: full name, address, home, mobile  and/or work phone number, marital status, signature, electronic signature, RFC, CURP, place and date of birth, age, names of family members, dependents and beneficiaries.

2) Professional data: profession, position, area or department, address, work telephone and email, extracurricular activities, work references, personal references, academic record, performance record, among others.

3) Patrimonial data: bonuses, salary deductions, movable and real estate properties, credit records, income and expenses, bank accounts, insurance, AFORES, bonds, contracted services, personal references, among others.

We also inform you that to fulfill the purposes of the employment relationship in this notice, sensitive personal data may be collected and processed, such as those that may reveal aspects like racial or ethnic origin, present and future health status, genetic information, religious, philosophical and moral beliefs, union affiliation, political opinions and sexual preference, among others. We promise that they will be treated under strict security measures, always guaranteeing their confidentiality.

We may collect your personal data in different ways: when you provide them directly to us, when you visit our website or use our online services and when we obtain information through other sources permitted by Law.

2.3. Purpose of Data Processing.

Your personal data may be used for the following purposes related to job performance:

  • Protection of employee benefits information.
  • Management of personal and/or family insurance such as automobile, major and minor medical expenses, life, serious illnesses, funerals, check-up, personal accidents, daily rent, mobile medical, etcetera.

  • Payroll and benefits management.
  • Issuance and management of benefits (such as food and gasoline vouchers), rewards, awards and executive memberships.
  • Performance evaluations and competency, training and work environment reports.
  • Information and contact with investors.
  • Information to customers and consumers.
  • Recruitment and staff selection.
  • Market research and product promotion.
  • Consultations, research and reviews in relation to the complaints or claims you present.
  • Advertising, promotional and market research.
  • General contact.

2.4. Data transfer.

Your personal information will not be transferred without your prior consent.

The personal data collected by any electronic or printed means for the purposes of production, marketing, market research and/or promotion of our products, as well as those derived from contractual and/or labor relations, will be treated under the terms of the Law, for storage, identification, administration, analysis, operation and/or disclosure. These data can be sent to third parties with contractual relationships with us. For this case, PROBIOMED will include, in the corresponding agreement, a clause that guarantees that third parties grant the level of protection of personal data required by the Law.

Likewise, in order to fulfill the purpose(s) previously described or others legally claimed or requested by the competent authorities, PROBIOMED may transfer certain information to third parties and to the aforesaid authorities.

At all times, PROBIOMED will safeguard the confidentiality of the data and the processing thereof in such a way that your privacy is protected in terms of the Law, guaranteeing compliance with this notice by the company and by those third parties with whom it maintains a legal relationship to the adequate provision of their services.

2.5. Exercise of ARCO rights.

In accordance with the provisions of the Law, you or your legal representative may exercise the rights of access, rectification, cancellation and opposition (hereinafter ARCO rights) by sending the corresponding request to the email address privacidad@probiomed.com.mx where specialized staff will attend you timely.

2.6. Revocation of Consent and limitation of use or disclosure.

You can revoke at any time the consent you have given us for the processing of your personal data, as long as it is not necessary to fulfill obligations derived from our legal relationship, so that we stop using or disclosing them. You can also limit their use or disclosure. To do this, you must send a request to the email privacidad@probiomed.com.mx.

2.7. Changes to the Privacy Policy.

Any change or modification to this policy may be made by this company at any time and will be published on the website www.probiomed.com.mx.

2.8. Privacy Committee.

The Data Privacy Committee will provide you with the necessary attention for the exercise of your ARCO rights and will ensure the protection of your personal data within the organization.
